I. DEFINITIONS
The terms used in these Terms and Conditions shall have the following meanings:
a) Business Days – days from Monday to Friday, excluding public holidays.
b) Consumer – a natural person entering into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
c) Digital Service – a service enabling the Consumer to:-
create, process, store, or access data in digital form;

share data in digital form, which has been transmitted or created by the Consumer or other users of this service;

engage in other forms of interaction with data.
d) Digital Content – data created and delivered in digital form.
e) Order – a completed electronic order form submitted by the User to order selected services from the Operator.
f) User – a natural person with full legal capacity who uses the thailand-arrivalcard.com website.

h) User Information – any data regarding the User or persons represented by them, provided to the Operator for the purpose of using the services.
i) Service Agreement – an agreement for the provision of services concluded between the Operator and the User.
j) Services – electronic services provided by the Operator, including: -
processing electronic travel permits to Thailand (also referred to as “Thailand Digital Arrival Card”);

travel advisory and assistance services.
II. GENERAL PROVISIONS
These Terms and Conditions specify the general terms and methods of providing electronic services via the website https://thailand-arrivalcard.com
These Terms and Conditions apply whenever you use our website or access our services through other means. By using our website, you confirm that you accept these Terms and Conditions and agree to abide by them.
The Terms and Conditions are always available on https://thailand-arrivalcard.com, allowing you to download, view, and store them by printing or saving them on a data carrier at any time.
The User is responsible for obtaining Internet access and possessing a compatible device connected to the Internet to purchase our services. The quality of service usage depends on several factors, including the User’s device and Internet connection quality. The website may be used if the User’s IT equipment meets the following minimum technical requirements: a computer or mobile device with Internet access, access to email, a browser (Firefox, Chrome, Safari, Internet Explorer, Opera) with enabled cookies and JavaScript.
The Operator informs that the public nature of the Internet and the use of electronic services may involve the risk of unauthorized access and data modification by third parties. Users should implement appropriate technical measures to minimize these risks, such as antivirus software.
The User acknowledges that 100% service availability is technically impossible. However, the Operator will make every effort to ensure the website and services operate as stably as possible.
The Operator does not guarantee the availability of telecommunications services from the provider or access to services at any time and place, nor any losses or damages related to the services.
The Operator provides advisory and assistance services in processing and verifying applications for electronic travel authorization to Thailand via the website.
The Operator is an independent service provider and is not affiliated with any governmental institution. The assistance includes completing and submitting applications for the Thailand Digital Arrival Card. The service fee covers professional support, application verification, submission, and all mandatory government requirements.
The Operator does not guarantee that the services or content are suitable or available in all jurisdictions and countries. The User is responsible for complying with all applicable laws regarding the use and access to the services in their region.
The Operator ensures that it has all the rights and authorizations necessary to conclude and execute this Agreement.
III. PROCESSING THE THAILAND DIGITAL ARRIVAL CARD APPLICATION
The Operator provides advisory and assistance services in processing and verifying applications for electronic travel authorization to Thailand through the website. The service includes:

Verification of submitted data,

Further processing and submission of the application to the relevant authority in Thailand.
The website provides an online form that must be completed to obtain a Thailand Digital Arrival Card. The form includes questions that must be answered, and the website offers a specialized review service to check the accuracy of the information before submission. Additional information may be requested, and any discrepancies may delay the processing.
The application may require specific details, including personal information, passport details, and travel purpose. If additional details are needed or the application is incomplete, the User will be notified via email. Verification delays may occur during processing.
After verifying that the information is correct and complete, the application will be submitted for approval. Once payment is received, the confirmation of the travel authorization will be delivered as soon as possible (maximum within 72 hours).
If the application cannot be processed, the User will be informed, and their payment will be refunded.
The User acknowledges that submitting an application does not guarantee approval. Final approval is at the discretion of the Thailand authorities. If denied, Users should consult the relevant embassy or consulate.
IV. PRICES / PAYMENTS
Service prices are expressed in US dollars (USD).
The processing fee for the travel authorization and related services includes:

Official government fee: no fee

Our service fee: $49.00
Payment can be made only via credit card (VISA, MasterCard, AMEX). In rare cases, and only by prior agreement, bank transfer payments may be accepted.
Clicking the “Pay and Submit Application” button constitutes a formal request to provide the selected services and initiates the online credit card payment process. After completing the transaction, the User will receive information about the payment and application result, also sent to the email address provided in the application.

V. REFUND POLICY
A User who is a Consumer has the right to withdraw from the contract within 14 days without providing a reason, by submitting an appropriate declaration before the deadline.
To meet the deadline, the Consumer only needs to submit the declaration to the Operator before the deadline expires.

Exclusion of the Right to Withdraw:
The right to withdraw does not apply to agreements where:
a) The Operator has fully performed the service with the Consumer’s express and prior consent, and the Consumer was informed beforehand that they would lose the right to withdraw once the service was completed, and they have acknowledged this.
VI. COMPLAINTS
Every User may submit complaints regarding the Services in writing via email: [email protected]
Complaints will be processed within 14 days from the date they are received by the Operator.
The Operator complies with Chapter 5B of the Consumer Rights Act concerning contracts for the supply of digital content or digital services.
(For Users in the EU) Under Article 14(1-2) of Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013, we are obliged to provide information about the ODR platform.
The Online Dispute Resolution (ODR) platform aims to facilitate independent, out-of-court dispute resolution between consumers and businesses via the Internet. These disputes concern contractual obligations arising from sales contracts or service contracts concluded online between consumers residing in the European Union and businesses based in the European Union.

VII. LIABILITY
The Operator reserves the right to suspend access to Services for periodic maintenance or in the event of technical issues, security threats, or other circumstances beyond the Operator’s control.
The Operator is not responsible for any damages resulting from the use or inability to use the Services by the User, including, but not limited to:
a) Unauthorized access to the Service or its unlawful use by any person,
b) Hacking attacks or similar incidents,
c) Force majeure events,
d) Acts or omissions of the User, telecommunications operators, or service providers.
The Operator is also not responsible for any lost profits of the User.
The Operator is not liable for any damages incurred by the User if the data provided by the User is incomplete, incorrect, or omitted, negatively affecting the application process.
The Operator is not liable for any damages resulting from decisions made by Thailand’s customs or immigration officers regarding the User’s entry onto an aircraft or vessel.
The Operator is not responsible for any damages arising from decisions to deny or revoke travel authorization to Thailand.
The Operator’s liability is limited to the amount paid by the User for the provided service.
VIII. SERVICE AVAILABILITY
The Operator guarantees service availability at 90% uptime annually.
This time does not include:
a) Periodic maintenance that may require temporary service suspension,
b) Interruptions due to force majeure, third-party interference, or other issues beyond the Operator’s control.
IX. PRIVACY
The Operator collects and processes Users’ personal data in compliance with applicable laws and the Privacy Policy.
The Operator implements appropriate technical and organizational measures to ensure the protection of processed personal data.

X. SEVERABILITY CLAUSE
If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, that provision shall remain enforceable to the maximum extent permitted by applicable law.
The unenforceable portion shall be deemed severed from these Terms and Conditions, and such determination shall not affect the validity and enforceability of the remaining provisions.
XI. FORCE MAJEURE
Neither party shall be liable for the failure to perform its obligations due to force majeure, including but not limited to:

epidemics,
-
floods,
-
fires,
-
storms,
-
shortages of raw materials,
-
transportation strikes,
-
partial or total strikes,
-
lockouts.
The party affected by such an event is obliged to notify the other party immediately, but no later than within five (5) business days of the event’s occurrence.
Both parties agree to cooperate to find the best solution for fulfilling the order during the force majeure situation.
XII. FINAL PROVISIONS
All rights to the Online Service, including copyrights, intellectual property rights to its name, domain, website, as well as forms and logos, belong to the Operator and may only be used in accordance with these Terms and Conditions.
Each User will be informed of changes to the Terms and Conditions through an announcement available on the main page of the Online Service.
These Terms and Conditions are governed by the laws of the Republic of Poland. The parties explicitly exclude the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The choice of applicable law by the parties shall not deprive the Consumer of protection resulting from mandatory legal provisions in the country where the Consumer has permanent residence within the EU.
